The West Virginia Gazette reports Oct 24, 2026 that environmental groups in the state sued after the AG subpeonaed their records under a consumer law.
The groups’ court filing revealed sweeping subpoenas issued by McCuskey’s office last month that demanded wide-ranging documents dating back to the start of 2017 pertaining to their public statements on climate and energy, internal deliberations about those statements, efforts to coordinate with third parties, groups that have funded their work and that they have paid, and staff or officers they have shared with any such groups.
This is misuse of the law. If the WV Attorney General has specific concerns, he should focus on them. This is intimidation and a fishing expedition. This kind of sweeping subpoena is intended to waste the organizations’ resources on paperwork and find some little thing the AG can follow up on.
NY State AG Letitia James did something similar to a conservative nonprofit that favored restricting immigration. West Virginia should not act like New York State.
